Most commercial disputes involve the use of expert witnesses to prove elements of the case. In this session, the speaker will discuss the factors that lawyers should consider when briefing and using expert witnesses from the perspective of our experience as experts in litigation and arbitration matters. We consider the stages of the expert evidence life cycle, including briefing an expert, the role of an expert, preparation of reports, contest of competing experts and giving evidence in court, and relevant issues that arise in each of these stages. The speaker will also discuss issues relevant to experts in the new Singapore rules of court effective from 1 April 2022. The contents of this seminar will be useful to any lawyer who uses experts in their line of work.
Ben Mahler | Executive Director | Singapore Ben specialises in providing expert business valuation, accounting, and data analytics services to clients. He is recognised as a Chartered Accountant Business Valuation Specialist by Chartered Accountants Australia and New Zealand. Ben has assisted in the preparation of expert witness reports submitted in the High Court of Singapore, various Australian State Supreme Courts, the Federal Court, and for use in arbitration. He has provided evidence in the Supreme Court of Western Australia, and prepared expert witness reports for the Supreme Court of New South Wales and the Supreme Court of Western Australia. Ben also has more than 15 years of experience ranging across investigations and fraud risk management, including short-term secondments to corporate clients.
